The Integration of the Council of Europe’s Minority Rights into Eu Law

This piece explore the complexities of minority governance in Europe, particularly focusing on the Council of Europe's Framework Convention for the Protection of National Minorities (FCNM) and its interaction with European Union (EU) policies. It highlights the historical context of minority treatment, the limitations of existing scholarship in addressing the dynamic nature of minority identities, and the need for a more integrated analytical framework that considers legal, political, and social factors. The document outlines a four-layer architecture of governance, detailing how minority rights are shaped by soft law, potential EU legal integration, enlargement conditionality, and the socio-political realities that influence minority identity formation. Ultimately, it suggests that while the incorporation of FCNM principles into EU law could enhance coherence and predictability in minority governance, it may also reduce flexibility and adaptive capacity in addressing the diverse realities of minority groups across Europe.
