Aggravating and Mitigating Circumstances and Their Role in Combating Cybercrimes: A Comparative Study Between the United Arab Emirates and Jordanian Legal Systems
Abstract
Shamma Mohammed Al Shehhi
The primary aim of criminal punishment is to combat crime and preserve social stability. Criminal policy, therefore, is not static; it evolves in response to changing societal conditions, technological progress, and the varying nature of offenses. This evolution reflects the need to align penal systems with the broader goals of justice, deterrence, and rehabilitation. In this regard, legal frameworks have developed various mechanisms to ensure flexibility in sentencing, including aggravating and mitigating circumstances, exemption clauses, and the suspension or substitution of sentences.
